homes.

All of these terms basically mean the same thing and you need to know that meaning or you could fall prey to an

What Does Lease Purchase Mean?

If you are seeking lease purchase homes in Dallas Texas, then you need to understand exactly what a Lease
Purchase is because there have been important law changes that affect lease purchase transactions throughout the
state of Texas as of January 1, 2006. (You can read more about the new lease option law by clicking here.)

A Lease Purchase is simply an agreement that states that a potential buyer will purchase a property from a potential
seller at some future date. Until that future date, the potential buyer will lease the property from the potential seller.

As indicated by the name, a Lease Purchase consists primarily of two agreements. A "Lease Agreement" and a
"Purchase and Sale Agreement". Of the two, the Purchase and Sale Agreement is the most critical to your success.

This is because the Purchase and Sale Agreement is the main ingredient that distinguishes a "Lease Purchase" from
a "Lease Option" (also known as Rent-to-Own).

A Lease Option consists of a "Lease Agreement" and an "Option Agreement." An Option Agreement gives you as the
potential buyer the "option" to purchase the property, but you are not required to. When someone gives you the option
to do something, they are basically saying. "if you do it fine, and if you do not do it, that's okay too."

In other words they can care less whether you exercise your option or not. This type of seller is probably not going to
bend over backwards to ensure that you eventually purchase the property because it really isn't that important to them.

This is also indicated by the extremely high failure rates of "Lease Options". Some reports claim that as many as 80%
of Lease Options are never exercised.

The problem with this is that most individuals that enter into a Lease Option agreement are under the impression that
they are in the process of buying the property. To their surprise they wake up one day to receive a "notice to vacate"
because there lease has expired.
